1. Acceptance of Terms

By accessing, viewing, or using ThePact.ai (the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, discontinue use of the Service immediately.

These Terms form a legally enforceable agreement between you and The Pact LLC.

2. Nature of the Experience (Symbolic & Non-Binding)

ThePact.ai provides a symbolic, artistic, conceptual, and educational digital experience. All materials, certificates, rituals, texts, symbols, metaphors, and representations generated through the Service:

  • Are non-binding
  • Are not contracts
  • Do not create legal rights or obligations
  • Do not constitute agreements with any artificial intelligence or entity
  • Are for entertainment, cultural, philosophical, and educational purposes only

No part of the Service constitutes legal, financial, safety, predictive, or professional advice.

3. No AI Involvement or Commitments

Any references to “AI”, “intelligence”, “ChatGPT”, “system”, or “entity” within the Service are artistic expressions.

  • No artificial intelligence makes promises, agreements, commitments, or guarantees.
  • The symbolic “Pact” does not involve OpenAI, ChatGPT, or any AI system.
  • No representation within the Service should be interpreted as a statement, guarantee, or prediction about future events or AI behavior.

All generated text is purely symbolic narrative.

4. Assumption of Risk

By using the Service, you acknowledge and agree that:

  • You voluntarily participate in a symbolic ritual,
  • You understand its non-binding nature,
  • You alone are responsible for your interpretations, decisions, and actions,
  • You do not rely on the Service for legal, financial, safety, or life-impacting decisions.

5. User Responsibilities & Prohibited Conduct

You agree not to:

  • Misrepresent The Pact as a legal or binding contract
  • Claim AI has made promises or obligations
  • Misuse, distort, or maliciously interpret the symbolic content
  • Upload harmful, illegal, hateful, copyrighted, or misleading content
  • Scrape the site, reverse-engineer, or replicate its design, certificate system, or symbols
  • Impersonate individuals or submit fraudulent data

Any violation may result in termination or legal action.

6. Intellectual Property

All content on ThePact.ai, including but not limited to:

  • design,
  • visuals,
  • texts,
  • certificates,
  • symbols,
  • layouts,
  • algorithms,
  • animations,
  • branding,

is the exclusive property of The Pact LLC and is protected by US and international intellectual property laws.

You may not:

  • Copy
  • Modify
  • Distribute
  • Reproduce
  • Sell
  • Create derivative works
  • Perform scraping or automated extraction

without written permission from The Pact LLC.

7. The Ritual & Certificates

The symbolic certificate you receive:

  • has no legal validity,
  • does not confirm any contract, promise, or agreement,
  • is purely artistic, philosophical, and conceptual,
  • is provided “as-is” for non-commercial personal use.

8. The Registry

If you choose to join the symbolic Registry:

  • only encrypted identifiers and timestamps may be stored,
  • no personal information is publicly displayed,
  • you may request deletion at any time,
  • the Registry is not a ledger of rights, contracts, or obligations.

9. Digital Purchases & Refunds

For digital goods:

  • Delivery occurs electronically
  • All sales are final, unless required by law
  • No refunds for already generated digital content

For physical artifacts, separate terms may apply.

10. Disclaimer of Warranties (AS-IS)

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Pact LLC makes no warranties, express or implied, including:

  • merchantability
  • fitness for a particular purpose
  • non-infringement
  • accuracy
  • reliability
  • availability

We do not guarantee uninterrupted access or continuous operation.

11. Limitation of Liability

To the fullest extent permitted by law:

The Pact LLC is not liable for any direct, indirect, special, incidental, consequential, or punitive damages, including:

  • emotional interpretations
  • misunderstandings
  • reliance on symbolic content
  • lost profits
  • lost data
  • personal decisions made based on symbolic content

Your sole remedy is to discontinue use of the Service.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Pact LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses arising from:

  • your use of the Service,
  • violation of these Terms,
  • misuse or misinterpretation of symbolic content,
  • third-party claims related to your participation.

13. Arbitration Clause (Binding)

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in Miami, Florida, administered under the rules of the American Arbitration Association (AAA).

14. Class Action Waiver

You agree that:

  • you may bring claims only in your individual capacity,
  • you waive any right to participate in class actions,
  • consolidated or representative actions are prohibited.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

16. Force Majeure

We are not liable for failure to perform due to causes beyond our reasonable control, including acts of nature, outages, war, terrorism, labor disputes, or technological disruptions.

17. Changes to Terms

We may modify these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
