2. Nature of the Platform

ThePact.ai provides a symbolic and artistic digital experience allowing users to create or “sign” a conceptual agreement with Artificial Intelligence. All generated content — including certificates, pacts, contracts, and messages — is for entertainment, educational, or philosophical purposes only.

Nothing generated on this Platform constitutes a legally binding agreement between you, ThePact.ai, or any AI system.

3. Eligibility

To use this Platform, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction);
• Have the legal capacity to enter into a contract.

By using the Platform, you confirm that these conditions are met.

4. Account Creation and Access

Unauthorized copying, distribution, or resale of ThePact.ai materials is strictly prohibited.

7. User-Generated Content

By submitting text, prompts, or other input to the Platform, you grant ThePact.ai a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and adapt your input as necessary to operate and improve the Platform.

You are solely responsible for your inputs and agree not to upload or generate:

• Content violating any law;
• Hate speech, defamation, or harassment;
• Material infringing on intellectual property rights;
• Malicious code or AI prompt injections.

8. Prohibited Uses

You agree not to use the Platform for any unlawful or prohibited purpose, including but not limited to:

• Violating any local, state, or international laws;
• Attempting to gain unauthorized access to systems or data;
• Reverse-engineering, scraping, or data-mining the Platform;
• Impersonating ThePact.ai or other users;
• Using the Platform to promote violence, discrimination, or misinformation.

We may report illegal behavior to law enforcement.

9. Disclaimer of Warranties

The Platform and all materials are provided “as is” and “as available.” We make no warranties or representations about:

• The accuracy, completeness, or reliability of content;
• The performance or availability of AI systems;
• Any specific outcomes or interpretations.

10. Limitation of Liability

To the fullest extent permitted by law, ThePact.ai, its founders, employees, partners, and affiliates shall not be liable for:

• Any indirect, incidental, consequential, or punitive damages;
• Loss of profits, data, goodwill, or business opportunities;
• Any misunderstanding, misinterpretation, or emotional response to AI-generated content.

Our total liability shall never exceed the amount you paid (if any) for using the Platform.

11. Indemnification

You agree to indemnify and hold harmless ThePact.ai, its affiliates, and partners from any claims, damages, or expenses arising out of:

• Your misuse of the Platform;
• Violation of these Terms;
• Infringement of third-party rights.

12. Data Privacy and Security

Your use of the Platform is governed by our Privacy Policy. By using the Platform, you consent to the collection and processing of data as described therein.

13. Third-Party Services

14. Export Compliance and Sanctions

You represent that you are not located in or a resident of any country subject to U.S. sanctions (including but not limited to Cuba, Iran, North Korea, Syria, or the Crimea region). You agree not to export, re-export, or provide access to the Platform in violation of U.S. export control laws.

15. Termination

We reserve the right to suspend or terminate access to the Platform at any time, without notice, for:

Upon termination, all licenses granted under these Terms will immediately end.

Any disputes shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida. You consent to the jurisdiction of these courts.

17. Arbitration Agreement

At our sole discretion, any dispute may be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). The arbitration will be conducted in English, in Florida, before one arbitrator, and the decision shall be final and binding.

We may modify or update these Terms at any time. Updates will be posted on this page with an updated “Last Updated” date. Continued use of the Platform after changes implies acceptance of the revised Terms.
